Our client, a male, then 22-year-old, was visiting a multi-family residence. Upon leaving, client stepped into a hole in a storm sewer grate as he was approaching his car. The client’s right leg was deeply lacerated and he sustained significant injury to his right knee when his knee, which was of greater circumference than the hole, slammed into the grate. Client required suturing for the deep laceration and he required surgery for torn knee cartilage. He was eventually diagnosed with a chronic pain condition in his right leg.

We took a statement from the property manager who admitted that she had known of the hole in the storm sewer grate for over two months but had not arranged for a repair. We also obtained a document which further corroborated that the property manager knew of the hole but had failed to repair it. We arranged for a life care plan to be prepared which estimated client’s life time medical care expenses. We also arranged for a vocational evaluation to determine the future impact on client’s earning ability.
The case settled for $1,000,000.
